On August 1st, 2024, Resolution 295/2024 became effective which sets forth a new official fee for the trademark applicant within the Opposition Resolution Procedure.
Applicants for new trademarks who are interested in the TRADEMARK OFFICE´s resolving the oppositions that were filed and in force against their applications, must pay a one-time fee per application within 15 business days from the notice to respond to the existing oppositions. If the fee is not paid, the application will be rejected.
Due to the high volume of pending trademark applications at the Opposition Resolution Department, which processes oppositions whose applicants have not answered the notice of existing oppositions –suggesting their lack of interest in the settlement of the dispute–, the new Resolution also provides a Temporary Clause allowing the TRADEMARK OFFICE to order the applicants who have not answered the notice of existing oppositions to pay the new corresponding fee within FIFTEEN (15) business days.
